Administrative Law is about the ways in which government power is regulated and reviewed. It is the body of law that applies rules and limits to the Crown, Cabinet, Ministers, government departments and tribunals. The course provides an overview of the Canadian legal system, including the branches of power and government.

The course outlines the procedures established to review the powers of these government bodies and the remedies available to correct any errors in procedural fairness and/or substantive misinterpretation or misapplication of the law. You will be taught to analyse and distil relatively complex facts, to relate the law as identified to the salient facts, and to reason towards a conclusion in the form of advice to a client or the likely judgment of a court confronted by such a problem.

Course Objectives

  • Prepare students to successfully complete the NCA Exam in Administrative Law*
  • Introduce and explain the relevant concepts and selections from materials to assist with exam preparation
  • Discuss circumstances under which government bodies are subject to obligation of procedural fairness to those affected by their decisions
  • Explain procedures and standards of review of government decision-makers
  • Provide overview of the remedies available to correct errors of procedural fairness, misinterpretation and misapplication of the law
  • Offer an opportunity to analyse and apply knowledge to practice questions and provide feedback
  • Review exam writing techniques to assist in the successful completion of the NCA exams
